Conditions of participation and data protection information for the referral program of Blackforest Solar Solution GmbH & Co. KG Version 1.0 – as of 16.03.2024
1. person responsible for the referral program
The recommendation program allows you to recommend a photovoltaic system or balcony power plant to family members, friends and neighbors. The campaign is offered and carried out by Blackforest Solar Solution GmbH & Co. KG, Ortenauer Straße 16, 77767 Appenweier (Freiburg Local Court, HRA 708490). Blackforest Solar Solution GmbH & Co KG is the controller within the meaning of Article 4(7) of the General Data Protection Regulation (GDPR). 2. eligibility to participate
2.1 Both customers of Blackforest Solar Solution GmbH & Co. KG and natural persons who have no business relationship with Blackforest Solar Solution GmbH & Co. KG (“existing customers” and “non-customers”) may participate in the referral program. If existing customers and non-customers send a referral link, they act as “recommenders”. The recipients of the referral link (“referrers”) are also eligible to participate and can be referrers themselves.
2.2 Referrers may not refer themselves or family members living in the same household for the referral program.
2.3 The recommender and the recommended must be two different natural persons who are at least 18 years old and have their permanent residence in Germany.
2.4 Employees of Blackforest Solar Solution GmbH & Co. KG and sales partners of Blackforest Solar Solution GmbH & Co. KG are excluded from participation in the referral program. This also applies to their family members who live in the same household.
2.5 Blackforest Solar Solution GmbH & Co. KG reserves the right to exclude persons from participation at its own discretion if there are justified reasons. This includes in particular a) Manipulations in connection with the implementation of the recommendation program; b) Violations of these Terms and Conditions of Participation, in particular information from recommenders about unsolicited advertising by recommenders; c) False or misleading information in connection with participation in the referral program.
3. recommendation process
3.1 Referral links that entitle the user to participate in the referral program can only be generated via the Blackforest Solar Solution GmbH & Co. KG website. The recommendation can be for a photovoltaic system or a balcony power plant.
3.2 The referral link can be sent by the referrer to any number of people, provided they are authorized to participate.
3.3 The non-binding inquiry by the referred party to purchase a photovoltaic system or a balcony power plant can only be made via the website to which the referral link redirects. If the recommended person submits a request to Blackforest Solar Solution GmbH & Co. KG in any other way, it will not be considered within the framework of the recommendation program.
4 Obligations of the recommender
4.1 The recommender undertakes to send the referral link only to recipients who have verifiably given their prior consent to the recommender to receive a referral link from the recommender.
4.2 The recommender may only use the recommendation link for personal, non-commercial purposes. The recommendation link may not be used for commercial activities of any kind. This includes, in particular, paid advertising campaigns, online advertising, public dissemination on websites, in social media, on blogs and in forums, which are primarily used to collect rewards. The recommender may not send the recommendation link to third parties via mass emails, short messages or messages or by means of automated systems or bots.
5. entitlement to premium and payment
5.1 If the Recommender submits an inquiry for a photovoltaic system or balcony power plant to Blackforest Solar Solution GmbH & Co. KG via the binding channel (see Section 3.1) on the recommendation of the Referrer and the Recommender orders an installation on the basis of this inquiry within six months of the initial submission of the inquiry, the Recommender shall receive a bonus. The premium for a photovoltaic system is up to 300 euros, for a balcony power plant the premium is 50 euros.
5.2 The entitlement to payment of the premium arises upon successful completion of the installation at the recommended party. The installation is deemed to have been successfully completed when the recommended party has settled the final invoice received from Blackforest Solar Solution GmbH & Co. KG in full.
5.3 The bonus is paid out exclusively to the referrer and in cash. The entitlement to payment of the premium is not transferable or negotiable. Payments are made in the local currency and exclusively by bank transfer.
5.4 Only those persons who have not violated the conditions of participation defined here are entitled to receive the bonus.
6. data protection
6.1 The participant’s e-mail address is processed for the purpose of providing and sending the referral link. The legal basis is the implementation of pre-contractual measures at the request of the data subject in accordance with Article 6 (1) lit. b GDPR. The referral link is sent to the e-mail address provided solely for the purpose of implementing the referral program.
6.2 If you have agreed to receive promotional emails as part of the referral program, your email address will also be used for sending advertising in accordance with Article 2 lit. a of Directive 2006/114/EC of the European Parliament and of the Council of December 12, 2006 concerning misleading and comparative advertising. The legal basis for this is Article 6 (1) lit. a GDPR.
6.3 If a referrer provides personal data after receiving a referral link, the processing of this data is subject to the privacy policy of Blackforest Solar Solution GmbH & Co. KG, which can be accessed on the Blackforest Solar Solution GmbH & Co. KG website.
6.4 If the requirements set out in section 5 are met and the
If the recommender is entitled to payment of the bonus, the account details for payment of the bonus will be requested and processed. The legal basis for this is Article 6 (1) lit. b GDPR.
6.5 The personal data processed by Blackforest Solar Solution GmbH & Co. KG as part of the referral program will not be passed on to third parties.
6.6 In accordance with the statutory provisions, every participant has the right to information about the processing of their personal data (Article 15 GDPR), the right to rectification (Article 16 GDPR), the right to erasure (Article 17 GDPR), the right to restriction of processing (Article 18 GDPR), the right to object to processing (Article 21 GDPR) and the right to data portability (Article 20 GDPR). The restrictions pursuant to Sections 34 and 35 of the German Federal Data Protection Act (BDSG) must be observed for requests for information and deletion. In addition, you have the right to lodge a complaint with the data protection supervisory authority in accordance with Article 77 GDPR in conjunction with Section 19 BDSG.
6.7 As part of the recommendation program, no automated decision-making or profiling within the meaning of Article 22 (1) GDPR takes place that would have legal effects on the recommender or the recommended person.
